Special Public Prosecutor Sureshchandra Modi said that on November 26, 2009, at 11 am, the police had received information that Nimbaram, son of Jiyaram, resident of Mekarna, was involved in the illegal opium trade. On this, Baytu would come with opium milk, on this, Jabta left with the police station officer and after reaching the border Madhasar Golai NH 112, blockade was done. During this time, at 3 o’clock in the afternoon, a person was seen coming from Madhasar side with a cloth bag in his hand. Seeing the police party, he got down from the road and started moving to the side. On questioning him on the basis of suspicion, he revealed his name as Nimbaram, son of Jiyaram, resident of Mekarna. When he was searched following the legal provisions, 200 grams of opium milk was found in a box from him.
Whose sample was sealed and the accused Nimbaram was arrested. A case was registered against the accused under NDPS Act and investigation was conducted. Charges were read to accused Nimbaram and evidence began. In the trial, a total of 8 witnesses were examined by the prosecution before the court. A total of 31 documents were displayed.
Special Judge NDPS Case Barmer Presiding Officer MR Suthar RHJS District Judge Barmer has sentenced a 73-year-old man to 4 years of rigorous imprisonment and a fine of Rs 20 thousand in the NDPS Act case. The accused Nimbaram, son of Jiyaram, resident of Mekarna, Pachpadra district, Balotra, has been found guilty of the crime under Section 8/18 NDPS Act and sentenced to 4 years of rigorous imprisonment.
After completing the evidence, the court, after hearing the arguments of both the parties, found the accused Nimbaram guilty of the crime of opium milk smuggling and sentenced him to 4 years of rigorous imprisonment and a fine of Rs 20,000. Advocate Sureshchandra Modi, a distinguished public prosecutor, appeared on behalf of the state government and Advocate Prem Prajapat appeared on behalf of the accused.
